The Daily Mark – Terms and Conditions

The Daily Mark will provide social media services as outlined in the proposal or agreement provided to you. The specific services, deliverables, and timelines will be detailed in the agreement.

Client Responsibilities
You are responsible for providing accurate and up-to-date information necessary for the provision of our services. You will also be required to provide access to social media accounts or platforms, as agreed upon.

Payment Terms
Payment for the services will be as outlined in the agreement. Invoices will be sent according to the agreed-upon payment schedule. Late payments may result in late fees and or the suspension or termination of services.

Intellectual Property
All intellectual property rights, including copyrights, trademarks, and other proprietary rights, related to the content created or provided by The Daily Mark shall remain the property of The Daily Mark unless otherwise agreed upon in writing.

Confidentiality
Both parties agree to maintain the confidentiality of any sensitive information shared during the term of this Agreement. Confidential information includes trade secrets, proprietary information, and client data.Termination
Either party may terminate this Agreement with 2 weeks written notice in the event of a material breach by the other party. Upon termination, you will be responsible for any outstanding fees for services provided up to the termination date.

Limitation of Liability
In no event shall The Daily Mark be liable for any indirect, incidental, consequential, or punitive damages arising out of or relating to the services provided, including but not limited to loss of data, loss of business, or loss of profits.Indemnification
You agree to indemnify and hold The Daily Mark and its employees, agents, and representatives harmless from any claims, damages, or liabilities arising out of your use of the social media services or any breach of this Agreement.

Governing Law
This Agreement shall be governed by and construed in accordance with the laws of [Your Jurisdiction]. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts in New Jersey.

Entire Agreement
This Agreement constitutes the entire agreement between the parties and supersedes any prior agreements or understandings, whether written or oral, relating to the subject matter herein.

By accepting the social media services, you acknowledge that you have read, understood, and agree to be bound by this Agreement.
